What Are Procedures in Louisiana After Being Arrested for 2 Warrants?
Question by Christy: What are procedures in Louisiana after being arrested for 2 warrants?
My father was arrested for domestic abuse battery by strangulation and domestic abuse child endangerment in Louisiana last week. My stepmother called the police out there around 2 weeks ago for the incident. She did not have a mark on her, and had gotten in his face and was hitting him because they were arguing. He eventually grabbed her around neck without hitting her to get her off of him. He decided to go to a mental hospital and was in there for almost a week and a half. At that point, I picked him up out of the hospital and brought him to another state to stay with me while the divorce procedures started. We drove back to Louisiana to get his stuff and called the sheriff’s office for an escort so no trouble would be started, and they arrested him on scene!!! He was trying to do the right thing. Now they are putting articles in newspaper lying saying he was abusing crack cocaine and prescription drugs! This is ridiculous. He took a drug test the day the police took him to the hospital, and he was clean. He recently had surgery, so he did have a prescription for pain meds, but he didn’t take not one while he was with me. They are going by what he said. He is a 54 year old man that has never been in trouble a day in his life. I don’t know how they can get away with this. The woman didn’t have a mark on her, and she said he threatened to kill her and his 2 year old daughter, which is ridiculous. That baby is his whole world. I don’t think he was treated fairly. His bond is 20k and we don’t have the money to get him out. I’m just curious to know when he will go to trial. No one will tell us anything. We can’t bail him out because we don’t have anyone to sign for him in Louisiana. He is a diabetic, and I’m worried about him! I know he shouldn’t have grabbed her, but this is ridiculous!
Thank you so much for being so nice! He can’t call a cell phone collect. I have not been able to speak with him, and it is just killing me. It is so sad! I know what he did was wrong but she was hitting him, and he tried to walk away but she followed. It’s a shame that either of them acted so inappropriately, but he doesn’t want to hurt her. He just wants to get on with his life and take care of his baby girl.

First of all, he will get excellent health care in jail.
As this is a complicated case, it will take his lawyer time to get things together, not to mention that the court system is very backed up.
He might not get to court for months.
Based on what you have said, and the fact that he went to the hospital and they kept him for a week and a half, it is very likely that his case will be dismissed. Pain pills can affect a person’s behaviour too. Tell the lawyer about the pills. Also offer to meet with the lawyer to give your side of Dad.
You can visit him and he can call you collect.
Because the abuse of women and children has reached such epidemic proportions, the police must handle these cases severely initially.
Hang in . This will come to an end.
Are you allowed to get all his stuff out now? It would be good if he could just have a fresh start when he gets out. DON’T get the stuff without a police presence .
