How Can One Get Out of a Domestic Abuse Charge?

Question by Jennifer P: How can one get out of a domestic abuse charge?
A few months ago an argument got pretty heated between my husband and I. He commenced to pushing me and slinging me around by my shirt. In the process, he knocked me on the floor and started kicking me. I held my hands up and tried to protect myself while pushing him off of me so I could escape.

I left my home and went to my mom’s work and called the cops. When they showed up they talked to me and then arrested me for Domestic Abuse and Property Damage. (My brother lied to the cops and told them that the Xbox in my home was his and I destroyed it.) My husband was charged with Child Endangerment, I assume because my children were in the car watching the whole thing. He had no bruises or scratches on him yet I had bruises on my neck, back, sides, and from my elbows to my shoulders on both arms.

I never once hit or pushed him except to get him off of me before he put me in the hospital. Apparently, the Louisiana police have been arresting both parties regardless of whether they are the victim or not. Basically, I was arrested and charged with Domestic Abuse because I was unable to control my drunken and drug-addicted husband.

Are these charges fightable? If so, what do I need to do? I am in school to become a teacher and I can not have anything like this on my record.
This was a first-time thing. He has not always been like this but got this way after being laid off due to the economy and all the stress of bills. I am not saying that it is okay because clearly it isn’t which is why I am no longer with him. I go to court on the 10th where I plan to plead not guilty and get a court-appointed lawyer. I am not even willing at this point to accept a deal of any kind which I know they will try to get me to do. I just relaly need this all to go away so I can finish my schooling (6 months left) and move on with my life.

You can get an attorney to try to have the charges dropped or proved to be false.

The problem is this. You know your husband is a drunken, drug-addict and continue to stay with him and put yourself and your children in danger. Police are starting to arrest both parties for both continuing to remain in these situations. Hoping to shock the women into leaving. Though, it’s one of the worst plans i have ever heard of.

You can fight it with an attorney and it can be taken off your record. If you continue to go back and continue to be with him, you will end up with this happening again and this time might be charged with Child Endangerment yourself, which will be difficult to get off of your record. Especially since you place your children in the home and continue to stay.

Domestic voilence is very hard situation to get yourself out of. I’ve been there myself. There are places to go that will help you and shelters to protect you. Go to them, ask them which lawyer to use to clear your record and get these charges dropped. Take the classes they have to help you not go back or get into future relationships with men like this. Seriously, it’s a learning process to never end up with a guy like that again, but if you go and really work on yourself, it’s possible!

best of luck.
